The ATSC 3.0 Patent Portfolio License provides coverage for the ATSC 3.0 Standard to the extent posted here.
The term of the license is five years, and it can be renewed for additional five-year terms. The initial term ends on December 31, 2027.
The License applies to any product that is capable of demodulating and channel decoding an over-the-air, RF terrestrial broadcast signal in compliance with the ATSC 3.0 Standard. Types of products include, but are not limited to, digital televisions, television tuners, media adapters, set top boxes, displays, and mobile, automotive and other computing devices that access or process ATSC 3.0 signals.
It is common for certain jurisdictions to provide tax incentives to companies if they complete the final assembly of a product locally (e.g., “knockdown kits”). Royalties are still due, however, either because the large majority of manufacturing or final use of the product still occurs in a jurisdiction(s) where there is significant patent coverage.
Any entity that sells (or is contemplating to sell) software and/or hardware that is capable of demodulating and channel decoding an over-the-air, RF terrestrial broadcast signal in compliance with the ATSC 3.0 Standard and is implemented in or capable of being implemented in an end user product.
While Licensors are under an obligation to grant to Via LA a worldwide, nonexclusive license under all ATSC 3.0 essential patents that it and its Affiliates presently or in the future have the right to license or sublicense, enabling Via LA to grant worldwide, nonexclusive sublicenses under terms of the ATSC 3.0 Patent Portfolio License, no assurance is or can be made that the License includes every essential patent. The purpose of the License is to offer a convenient licensing alternative to everyone on the same terms and to include as much essential intellectual property as possible for their convenience; however, participation in the License is voluntary on the part of essential patent holders.
Any party that believes it has patents that are essential to the ATSC 3.0 Standard and wishes to participate in the ATSC 3.0 Patent Portfolio License upon successful evaluation, is invited to submit them for evaluation and inclusion. Please contact Via LA at ProgramManagement@via-la.com to request a copy of the submission procedures and the terms and conditions governing the submission of patents for essentiality determination in order to join the ATSC 3.0 Licensing Program.

Licensees must report the sales of licensed products on a semi-annual basis, using a secure website. The specific information required in the semi-annual reports is simply the product designation (name and/or model number) and the number of units of each product sold in the reporting period.
Yes, we highly encourage such entity to secure this license and lock in the current offering. And in addition, if you would like to lock in the additional 30% discount off Via LA’s already competitive pro-market standard royalty rate, you must execute the license on or before October 30, 2023. This will enable you to obtain a single and cost-effective license to standard essential patents owned by 14 innovators at extremely competitive rates and lock in these terms. You do not need to report any licensed product sales until you start adopting ATSC 3.0 in your product line.
