Via LA’s MPEG-2 Systems Patent Portfolio License provides access to patents that are essential to the MPEG-2 Systems coding standard used in products, such as set-top boxes, cameras and mobile television and audio receivers, without licensed MPEG-2 video encoders or decoders. The MPEG-2 Systems Standard defines how to format the various components of multiplexer programs and combine them into a single program or transport stream.

* “Mobile MPEG-2 Systems Digital Receiver” shall mean a device that cannot receive an MPEG-2 Systems Standard compliant signal except via wireless communication according to a mobile wireless broadcast standard such as the ARIB Specifications for “1-segment” receivers (1seg), TIA-1099 (MediaFLO), TTAS.KO-07.0027 (S-DMB), ETSI TS 102 427 and ETSI TS 102 428 (T-DMB), Doc. A/153 ATSC-M/H Standard Parts 1-8, and ETSI EN 302 304 (DVB-H) standards.
- MPEG-2 Systems Patent Portfolio License covers devices in products that use the MPEG-2 Systems Standard without MPEG-2 video encoders and decoders
- The present terms continue through expiration of the last MPEG-2 Systems Patent Portfolio Patent
Currently, patents are only active in Malaysia.
Both the coverage effective date and back royalty date are January 1, 2006.

For as long as they continue to be a Licensee, those Licensees with a license in effect prior to the date of such Licensor’s termination retain their license to such Licensor’s MPEG-2 Systems Patent Portfolio patents that the Licensor or its Affiliates presently or in the future has the right to license or sublicense (without payment to any third party which is not an Affiliate), including on or after such termination date. Please see the Patent List page and reference the Attachment 1 addendum for specific termination dates.*Terminated. For as long as they continue to be a Licensee, those Licensees who entered the MPEG-2 Systems Patent Portfolio License before a Licensor’s termination are covered under all MPEG-2 Systems Essential Patents that the terminated Licensor and its Affiliates presently or in the future has the right to license or sublicense, but coverage is not available to Licensees who enter the MPEG-2 Systems Patent Portfolio License after the Licensor’s termination date. This is a list of patents (Attachment 1) in the MPEG-2 Systems Patent Portfolio License (updated October 1, 2025). Under the MPEG-2 Systems Patent Portfolio License, royalties are payable for products Manufactured or Sold in countries with an active MPEG-2 Systems Patent Portfolio Patent at the time of Manufacture or Sale. Please note that the last US patent expired February 13, 2018, and patents are presently active in Malaysia.
What does the MPEG-2 Systems Patent Portfolio License cover?
The MPEG-2 Systems Patent Portfolio License provides coverage for the MPEG-2 Systems standard as specified in ISO documents IS 13818-1 (including annexes C, D, F, J and K) in products without licensed MPEG-2 video encoders or decoders.
Who are the essential patent holders ("Licensors") to the MPEG-2 Systems Patent Portfolio License?
What are the obligations of the Licensors with regard to their essential MPEG-2 Systems Essential patents?
Each Licensor is under an obligation to grant to Via LA a worldwide, nonexclusive license under all MPEG-2 Systems Essential Patents that it has the right to license or sublicense presently or in the future (without payment to any third party), enabling Via LA to grant worldwide, nonexclusive sublicenses under such patents under terms of the MPEG-2 Systems Patent Portfolio License.
What is the effect on Licensees when new patents are added to the MPEG-2 Systems Patent Portfolio License?
The royalties payable under the License do not increase or decrease because of an increase or decrease in the number of MPEG-2 Systems Essential Patents or because of an increase or decrease in the prices of a Licensee’s MPEG-2 Systems Royalty Products. Rather, they are the value of a license granted under the Patent Portfolio taking into consideration the commercial intention of the Licensors to facilitate adoption of the MPEG-2 Systems Standard and make available a pool license in which royalties are the same whether one or more patents is used. New Licensors and new patents are added with no increase in royalty rates during the current Term of the License.
Are all MPEG-2 Systems essential patents included?
While Licensors are under an obligation to grant to Via LA a worldwide, nonexclusive license under all MPEG-2 Systems Essential Patents that it and its Affiliates presently or in the future has the right to license or sublicense, enabling Via LA to grant worldwide, nonexclusive sublicenses under terms of the MPEG-2 Systems Patent Portfolio License, no assurance is or can be made that the License includes every essential patent. The purpose of the License is to offer a convenient licensing alternative to everyone on the same terms and to include as much essential intellectual property as possible for their convenience; however, participation in the License is voluntary on the part of essential patent holders.
How may a patent holder become a Licensor to the MPEG-2 Systems Patent Portfolio License?
Any party that believes it has patents which are essential to the MPEG-2 Systems Standard, and wishes to participate in the MPEG-2 Systems Patent Portfolio License upon successful evaluation, is invited to submit them for evaluation and inclusion. Please contact Via LA at ProgramManagement@via-la.com to request a copy of the submission procedures and the terms and conditions governing the submission of patents for essentiality determination in order to join the HEVC Licensing Program.
How many licenses does an MPEG-2 Systems user need?
It is up to each user to determine its own licensing needs and how it wishes to meet them. The MPEG-2 Systems Patent Portfolio License is provided for a user’s convenience in acquiring patent rights necessary for the MPEG-2 Systems Standard from multiple essential patent holders in a single transaction as an alternative to negotiating separate license agreements with individual Licensors. Users are free to negotiate directly with one or more Licensors for a separate license under one or more Essential Patents under independently negotiated terms, however. In addition, as discussed above, users who take Via LA’s license may have to negotiate licenses for essential patents that are not included. A license also may be necessary for other important patents (that are not essential to the MPEG-2 Systems standard).
